Terms of Service

These terms cover how you use Ad Titan and how you connect and authorize your advertising accounts. We've kept them as plain as the product itself.
1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you (and the organization you represent) and MAK Technologies Inc, which runs the Ad Titan platform ("Ad Titan", "we", "us"). When you create an account or use the service, you agree to them. If you're using Ad Titan for an organization, you're confirming you have the authority to accept these Terms for it.
Your use of Ad Titan is also covered by our Privacy Policy, which is part of these Terms.
2. The service
Ad Titan is a paid-media management platform. It monitors your connected advertising accounts, raises alerts, gives you analysis and reporting, and, with your approval, applies optimizations back to those accounts. We may add, change, or remove features over time.
Ad Titan reads your ad-account data and stays read-only until you approve a change. Anything it does apply on your instruction is recorded, and you can reverse it from inside the product.
3. Accounts and eligibility
You need to be at least 16 and able to enter a binding contract to use Ad Titan. You're responsible for the accuracy of your account details, for keeping your login secure, and for everything that happens under your account, so tell us right away if you spot any unauthorized use. You're also responsible for how your team members use the workspace.
4. Connecting your ad accounts
To use most features, you connect your Google Ads and/or Meta Ads accounts through their official OAuth flow. When you connect an account, you authorize Ad Titan to read it and, where you approve a change, update it through the platform's API on your behalf.
You confirm that you have the right to connect each account and to authorize these actions. You can revoke access whenever you like, by disconnecting the account in Ad Titan or in your Google or Meta settings. You stay responsible for any change made through the service, including the ones you approve.
5. Acceptable use
Please don't:
- Use the service in a way that breaks the law or the terms of Google, Meta, or any other connected platform.
- Access accounts or data you aren't authorized to manage.
- Reverse-engineer or resell the service, or try to disrupt it or break into it.
- Upload malicious code, or use the service to send spam or infringe someone else's rights.
- Misrepresent who you are or your authority to act for an organization.
6. Third-party platforms
Ad Titan works alongside third-party platforms like Google Ads and Meta. Your use of those platforms is governed by their own terms, and you're responsible for following them. We're not responsible for the availability, accuracy, or actions of any third-party platform, and changes they make can affect how features work.
7. Fees
If your plan has fees, you agree to pay them as set out at sign-up or in your order. Unless we say otherwise, fees aren't refundable, and we may change pricing with reasonable notice. A free trial only becomes a paid plan in the way we describe when you start it.
8. Intellectual property
Ad Titan, including its software, design, and content, belongs to us and our licensors and is protected by law. We give you a limited, non-exclusive, non-transferable right to use the service while you're subscribed. You keep ownership of your data and the content you provide, and you give us the rights we need to run and improve the service. If you send us feedback, we can use it freely.
9. Disclaimers
Ad Titan gives you tools, analysis, and recommendations to help you manage advertising. It doesn't guarantee any particular result, ranking, spend, or return, and your advertising decisions are your own. The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
10. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or advertising spend. Our total liability relating to the service won't exceed what you paid us for it in the twelve months before the event that led to the claim (or one hundred US dollars if you paid nothing).
11. Indemnification
You agree to defend and cover us against claims, damages, and costs that come from your use of the service, your data, or your breach of these Terms or of any third-party platform's terms.
12. Term and termination
These Terms apply for as long as you use the service. You can stop using Ad Titan and close your account whenever you like. We may suspend or end your access if you break these Terms, if the law requires it, or to protect the service or other users. When access ends, your right to use the service ends too, but the sections that are meant to last (like intellectual property, disclaimers, and limitation of liability) still apply.
13. Changes to these terms
We may update these Terms now and then. When we make a meaningful change, we'll update the date above and, where it makes sense, let you know. Using the service after an update means you accept the new version.
14. Governing law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law rules, and any dispute will be handled by the courts located there, unless a mandatory law where you live says otherwise.
